First Time Buyers

If you have not bought with us before, we suggest you carefully read the following guide to buying at O’Donovan & Associates. Our Conditions of Sale may be accessed at any point, which should be read in conjunction with this brief guide. Registration: We operate a paddle bidding system. To bid at auction you will need a paddle number. To register for a paddle you must fill in and sign a Bidder Registration Form. You may be asked to supply identification upon registration, particularly for first time bidders, by way of passport, driving licence together with a credit card. The Auction: Lots are offered for sale in numerical order as they appear in your catalogue. We offer for sale an estimated 80-120 lots per hour, depending on the particular category of sale. We strongly recommend that you arrive in plenty of time before the lot you are wishing to bid on is up for sale. Bids are increased at the Auctioneers discretion by approximately 10% of the bid price. To bid, raise you paddle clearly and promptly, allowing sufficient time for the Auctioneer to note your number upon the success of your bid. It is important to note your paddle number, as this will be your reference for later payment.

Absentee Bidding

Written Bids – If you cannot attend an auction in person, O’Donovan & Associates can bid on your behalf, acting upon your instructions to secure an item for you at the lowest possible price This is a free service which enables you to fill out an Absentee Bidding Form, detailing your bids, giving your price limit for any specific lot, requesting us without legal obligation of any kind, to bid on your behalf. Purchasers premium incl. VAT will be payable on the hammer price in the event of a successful bid. All bids must be received within 24 hours before the sale in order to ensure their execution.

Telephone Bids – An alternative to written bids is telephone bidding. This may be arranged on lots with a minimum estimate of €50. As the number of telephone lines is limited, early booking is recommended. (We also recommend that you leave an “emergency cover” bid in case we are unable to reach you by telephone.)

Buyers Premium: The buyer shall pay the Auctioneer a commission at the rate of 15% on the Hammer Price excl. of VAT @23% on all individual lots.

Payment: All purchases must be paid for within two calendar days of the sale. Our payment terms are cash, bankers draft or cheque* drawn on an Irish Bank. Cheques should be vouched to the satisfaction of the Auctioneers prior to sale. Goods will only be released upon clearance through the bank of all monies due. *Cheques take a minimum of five working days to clear the bank.

Collection: Collection of purchases is at the responsibility of the buyer. We are happy to assist the buyer in recommending a carrier, however goods remain at the buyers risk from the fall of the hammer. Goods remaining uncollected two days after the auction date will be subject to storage & handling charges, therefore it is important that you make collection within the designated time, as detailed in the important information for purchasers in your sale catalogue. If you are unable to remove your item immediately you will need to arrange storage and shipping. All lots are given pre-sale estimates from which reserves may be placed indicating the minimum price at which the lot may be sold. All reserves must be agreed with the Auctioneer 24 hours in advance of sale. Pre sale advices are issued prior to sale with the sale date & time together with descriptions of each lot, their agreed estimate and reserve. Payment is issued approximately one week from the date of sale by way of cheque together with a statement attached detailing your deductions. Payment will only be made when all monies due from the buyer have been paid & cleared in accordance with our conditions of sale. All payments are made in Euro, unless otherwise instructed. Specific payment instructions will be accepted in writing prior to sale.

Sellers Commission: The following are the standard rates of commission for selling at O’Donovan & Associates categorised by sale (including all other specialist sales). These rates are standard rates subject to change, any queries regarding commissions should be addressed to our Accounts Department on info@odonovan.ie

The purchaser of each lot in the auction shall be the person deemed to be the highest bidder by the auctioneer. If a dispute should arise as to who is the highest bidder then it shall be at the auctioneers discretion to either offer the item for sale again or to continue bidding from the last un-disputed bid.
The auctioneer has the right to bid on behalf of the vendor on reserved items to help to attain the reserve price.

The purchaser shall pay the hammer price plus 20% incl. VAT buyer’s premium for each and every lot purchased at the auction. All lots are subject to a minimum charge of €5.00 per lot (incl. VAT at 23%). We accept cash and all major debit and credit cards (credit cards attract a 2% +VAT surcharge). If you wish to pay by cheque, lots will only be released by us when the funds are secure in our account.

No purchased items of furniture shall be removed from the auction room during the auction; smaller items can be removed only with the assistance of a porter.

No items shall be removed from the auction rooms without they being first fully paid for and the relevant documentation presented to a porter.

It is the responsibility of the purchaser to ensure that the items they are bidding on have been viewed properly during the viewing period. Defects detected after sale by the purchaser will not void sale.

It is the responsibility of the purchaser to remove all purchased items from the sale room within a period of five (5) working days. Storage charges will apply to items at a rate of €5 per day basis after this time. We will undertake postage and packing of lots where possible at the buyer’s risk.

The auctioneer reserves the right not to accept bids offered by any person or persons without giving reason for this action.

Whilst the auctioneers make every effort to ensure the accuracy of their catalogue and the descriptions therein, each lot is sold by the vendor with all faults, imperfections and errors of description. Buyers should satisfy themselves prior to the auction as to the condition of each lot, and any statement by the auctioneers as to the lot is a statement of opinion only as every person should rely on his/her own judgement as to all matters affecting the lot.

PAINTINGS & SCULPTURE

When the Forename(s) and Surname of the Artist are given, in our opinion this is a work of the Artist.

When the Initials of the Forename(s) and the Surname of the Artist are given, in our opinion this is a work of the period of the Artist which may be wholly or partly his work.

When the Surname only of the Artist is given, in our opinion this is a work by the school, or by one of the followers of the artist, or in his style and of uncertain date.

Purchasers are allowed seven days from the date of the Auction to satisfy themselves as to the accuracy of the catalogue description.
